Agreement to Terms

By placing an order with Nino's Club House ("we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Sale. Please read these terms carefully before making a purchase. If you do not agree to these terms, please do not place an order.

These Terms of Sale should be read in conjunction with our Privacy Policy, Returns & Refunds Policy, and Shipping Policy.

All products are subject to availability. We reserve the right to discontinue any product at any time. If a product becomes unavailable after you place an order, we will notify you and offer a full refund or substitute product.

    • Cancel the order for a full refund

We are not obligated to honor pricing errors.

4.3 Processing Time

Orders are typically processed within 1-3 business days (excluding weekends and holidays). During high-volume periods (sales, holidays), processing may take longer.

4.4 Order Modifications and Cancellations

  • Orders may be cancelled within 2 hours of placement
  • After 2 hours, we cannot guarantee cancellation or modification
  • Once an order has shipped, it cannot be cancelled

5. Shipping and Delivery

5.1 Shipping Policies

5.2 Shipping Charges

  • Shipping charges are calculated at checkout based on destination and shipping method
  • Free shipping promotions may be offered with minimum purchase requirements
  • We are not responsible for delays caused by shipping carriers

5.3 Delivery Address

  • You are responsible for providing accurate shipping information
  • We are not responsible for orders shipped to incorrect addresses provided by the customer
  • If an order is returned to us due to an incorrect address, additional shipping charges may apply for reshipment

5.4 Risk of Loss

All items purchased from Nino's Club House are made pursuant to a shipment contract. Risk of loss and title for items pass to you upon delivery to the carrier.

5.5 International Shipping

  • International customers are responsible for all customs duties, taxes, and brokerage fees
  • Delivery times are estimates and not guaranteed
  • We are not responsible for delays caused by customs processing

6. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our separate Returns & Refunds Policy. By placing an order, you agree to the terms outlined in that policy.

  • 30-day return window from delivery date
  • Items must be unworn, unwashed, with tags attached
  • Customer responsible for return shipping costs (except defective items)
  • Certain items are non-returnable (intimates, swimwear, final sale items)

7. Warranties and Disclaimers

7.1 Product Warranty

We warrant that products will be free from defects in materials and workmanship under normal use for 30 days from the date of delivery. This warranty does not cover:

  • Normal wear and tear
  • Damage from misuse, neglect, or improper care
  • Alterations or modifications
  • Items not purchased directly from Nino's Club House

7.2 Disclaimer of Warranties

  • Any defects will be corrected

8. Limitation of Liability

8.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) IN QUESTION.

This limitation applies regardless of the legal theory upon which your claim is based.

8.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Intellectual Property

All content on the Nino's Club House website, including but not limited to text, graphics, logos, images, photographs, designs, and software, is the property of Nino's Club House or its licensors and is protected by copyright, trademark, and other intellectual property laws.

"Nino's Club House" and all related logos, product names, and service names are trademarks of Nino's Club House. You may not use these trademarks without our prior written permission.

Any dispute arising from or relating to these Terms of Sale or your purchase shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. The arbitration shall take place in The United States of America.

13.4 Class Action Waiver

You agree to resolve disputes on an individual basis only, and waive any right to participate in a class action lawsuit or class-wide arbitration.

13.5 Exceptions

The following disputes are not subject to arbitration:

  • Disputes related to intellectual property rights
  • Requests for injunctive relief

13.6 Jurisdiction

If arbitration does not apply, you agree that any legal action shall be brought exclusively in the state or federal courts located in The United States of America, and you consent to personal jurisdiction in those courts.

14. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (natural disasters, severe weather)
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Labor strikes or disputes
  • Supplier failures or shortages
  • Pandemics or epidemics
  • Failures of third-party service providers (shipping carriers, payment processors)
  • Technical failures or cyberattacks

15. Severability

If any provision of these Terms of Sale is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Sale, together with our Privacy Policy, Returns & Refunds Policy, and Shipping Policy, constitute the entire agreement between you and Nino's Club House regarding your purchase and supersede all prior agreements and understandings.

17. No Waiver

Our failure to enforce any provision of these Terms of Sale shall not constitute a waiver of that provision or any other provision.

18. Assignment

You may not assign or transfer your rights or obligations under these Terms of Sale without our written consent. We may assign our rights and obligations without restriction.

19. Survival

Provisions that by their nature should survive termination shall survive, including but not limited to warranties, disclaimers, limitations of liability, and dispute resolution provisions.
